If it's found the order is truly discriminating based on religion, it won't survive, said David Jones, a veteran immigration lawyer and partner in the global immigration practice at Fisher Phillips.
"The administration is relying on the fact that (Barack) Obama labeled these specific seven countries," he said. "But if the facts are right, there have been no terrorist attacks from those countries in 40 years."
Health, higher education and technology sectors rely on highly educated foreign nationals to take jobs that can't otherwise be filled domestically, Jones said. Hospitals in particular often look to fill underserved areas with medical graduates who just happen to be overwhelmingly Iranian and Pakistani.
