A union that won an election to represent a group of Boeing mechanics has sued the NLRB, claiming the board’s decision to block the workers from organizing separately from others on the 787 Dreamliner assembly line violated federal labor law. Law360 spoke with Steve Bernstein, co-chair of the firm’s national Labor Relations practice on what this suit means. He said the complaint struck him as a unique and rare attempt to challenge an agency’s authority. “They’re asking the court to disturb a representation decision from an agency that has the discretion to make such decisions.”
