Labor-related cases will have a busy year in federal courts in 2023. Steven Bernstein was tapped by Law360 to discuss some of the biggest cases to watch in the new year.
One such case, Glacier Northwest Inc. v. International Brotherhood of Teamsters Local Union 174, a lawsuit filed by a Washington concrete company seeking compensation for property destroyed by workers during a work stoppage, could affect how unions conduct strikes and possibly give justices a vehicle to adjust a decades-old labor preemption doctrine.
Steven explains that the ruling may go beyond simply discouraging some union strikes, as the court may create a larger carve-out in the Garmon preemption doctrine. "It's entirely possible that they come away with a fairly sweeping decision that's much broader than the facts in front of the court," he says.
