Labor Relations Co-Chair Discusses Biden’s Pick for NLRB’s Top Lawyer with Law360

In an interview with Law360, Steven Bernstein shares his insights on Jennifer Abruzzo's confirmation as NLRB general counsel. Steve explains that while Abruzzo may signal Biden’s sharp break from the previous administration, that process already began with the previous appointment of career NLRB staffer Peter Sung Ohr. "Whatever process you might expect, that's already been underway," he says. Steve also notes that Abruzzo is likely to enforce a broad view of the NLRA over the right of workers to engage in political protest or other socially focused activity. "That has from time to time been deemed protected, but on other occasions less so. That seems to be a priority of the current administration and I would expect her to carry that out."
