Are you new to the mining industry? Does your business provide services at mine sites? Working at a MSHA-regulated facility presents certain compliance challenges not present in general industry. MSHA regulators are a constant presence at mine sites and possess certain authority not held by other governmental agencies. Those in the mining industry should have a working knowledge of how MSHA enforcement works.
This webinar, presented by Fisher Phillips partners Chris Peterson and Arthur Wolfson, will cover basic terms and concepts that anyone may interact with MSHA in the course of their business should know. Topics covered will include:
- The scope of MSHA authority
- Who constitutes an “operator” that is subject to MSHA jurisdiction
- The types of enforcement actions that MSHA may issue
- Gravity, negligence and other special designations
- Individual liability against company agents
- Whistleblower complaints
In addition to an explanation of these legal concepts, this webinar will be illustrated by real-world examples. Participants will have the chance to ask questions and share examples of their own.
