David Jones, an immigration partner in Memphis, was quoted in the National Law Journal article “Why Management Lawyers Are Tracking DOJ's Suit Against California.” This article discusses the federal government lawsuit challenging the California immigration law and the effect on employers.
The new California state law dictates companies cannot voluntarily allow U.S. Immigration and Customs Enforcement to access workplace records. This law imposes restrictions on federal immigration enforcement as the current administration increases efforts to stop illegal immigration.
David said, “We are closely watching this. It puts employers on this tightrope: They have ICE on the one side saying, ‘This is how you have to do things.’ And they already have to make sure they don’t go too far and that they aren’t discriminating.” Though employers want to comply with federal law, they are not relieved from California law.
