Houston Partner Discusses Likely Challenges to Biden’s Vaccine Mandate

In an interview with Commercial Carrier Journal, Kevin Troutman discusses potential legal challenges to Biden’s vaccine mandate. “We expect industry groups and some states to mount court challenges to the OSHA Emergency Temporary Standard (ETS) when it is issued,” Kevin says. “Specific rules and limitations apply to the issuance of an ETS and many such standards have been successfully challenged in the past.” He adds, however, that employers risk fines if they do not comply. “Until those challenges are resolved or a court issues an injunction, however, covered employers who do not comply with the ETS will risk incurring significant fines. Keep in mind that the rule is expected to include an option for weekly testing instead of vaccination, which may be helpful to some employers.”
