Healthcare Co-Chair Talks to the Media About Vaccine Showdown at the US Supreme Court

In interviews with Modern Healthcare and Inside Health Policy, Kevin Troutman discusses the showdown at the US Supreme Court relating to the CMS healthcare vaccine mandate.
In the Modern Healthcare article, Kevin was asked what he thought about Justice Coney Barrett’s indication that CMS might have authority to institute a vaccine mandate in some healthcare facilities but not others. In response, Kevin explained that “[t]he pressure to issue a ruling quickly makes it less likely that the court will let the mandate stand in some facility types and not others.”
And in his interview with Inside Health Policy, Kevin explains that the federal government provided compelling arguments in support of its vaccine mandate in healthcare settings. “It would not surprise me to see the CMS mandate survive because Medicare and Medicaid participants agreed to abide by conditions of participation [in Medicare and Medicaid] from the outset,” said Kevin. He went on to explain that “protecting the safety of patient populations is another compelling distinction between the OSHA [Emergency Temporary Standard] and the CMS mandate.”
