Healthcare Co-Chair Discusses States’ Revamped Challenge to Vaccine Mandate

Kevin Troutman was interviewed for a Modern Healthcare article about several states’ revamped challenge to the federal COVID-19 vaccine mandate for healthcare workers at Medicare and Medicaid-certified facilities.
As the deadline for employee vaccination by Feb. 14 approaches, these states are trying to block that mandate, arguing that the Centers for Medicare and Medicaid Services (CMS) went beyond its constitutional authority and is infringing on the states’ powers. They also argue that circumstances have changed since the policy was written, in large part due to the Omicron variant.
Overall, Kevin thinks the case will be an uphill climb for the states, but he is quick to point out that “[t]hey’ve come up with a pretty interesting angle, and some of the arguments that they’re making in this amended complaint, it’s hard to ignore."
