Rich Meneghello was quoted in the Bloomberg Law Daily Labor Report article “GrubHub Wage Case May See New Delivery: Worker Status Test Redo.” A case in a federal court in California involving GrubHub could upend worker classification in the gig economy. And a separate case in the state supreme court could upend the GrubHub case.
The case Dynamex Operations W. v. Superior Court is the first to reach trial over the question of whether workers are independent contractors or employees.
“Even though this district court case won’t be precedent-setting, a good way to look at it is that it will set the table,” Rich told Bloomberg Law. “A lot of courts will be looking to it to set the initial lay of the land.”
