Steve Bernstein offered insight to an Law360 article on the NLRB announcing that it had decided to relaunch its push to change the rules and regulations governing its representation case procedures, in a 3-2 vote along party lines.
The NLRB's efforts to use its rulemaking power to alter the union election process have drawn tens of thousands of public comments, including sharp criticism from business groups and attorneys who complain that the potential changes are sweeping, according to the article.
Critics argue that an expedited election process will handcuff employers when it comes to communicating with workers about unionization and impose burdens some companies won't be able to handle.
“I think the upshot of all of this is that even the most sophisticated businesses are going to need a great deal of guidance simply to understand their obligation under their new rules, and I'm not convinced some less sophisticated businesses will be able to do so within the time constraints imposed,” Steve said.
