Fisher Phillips Partner Todd Scherwin Named to Daily Journal’s 2019 Top Labor and Employment Lawyers List

LOS ANGELES (July 12, 2019) – Fisher Phillips Regional Managing Partner in Los Angeles Todd B. Scherwin has been named to the Los Angeles Daily Journal’s 2019 “Top Labor and Employment Lawyers in California” list. In its annual feature, the publication recognizes its top 75 California attorneys, accepting nominations from across the state, and selection is based on attorneys’ caseload and achievements in their practice.
Over the course of his practice, Todd has defended employers in countless high-stakes matters. Todd recently helped set legal precedent, defending Encino Motorcars as part of the team that argued before the U.S. Supreme Court in the landmark Encino Motorcars, LLC v. Navarro case.The court held in April 2018 that service advisors are exempt from the Fair Labor Standards Act’s overtime-pay requirement, ratifying nearly 40 years of established pay practices for service advisors at dealerships nationwide. Additionally, the Daily Journal highlights Todd’s defense of a credit card processing service provider in a wage and hour class action and a waste management company facing a wrongful termination lawsuit.
Todd represents employers in Private Attorney General Act (PAGA) actions and class actions; employment discrimination, harassment, and retaliation claims; trade secret protection matters; and administrative proceedings. He has defended employers before federal and state administrative agencies including the U.S. Department of Labor, the California Division of Labor Standards Enforcement (DLSE) and the California Unemployment Insurance Appeals Board (CUIAB).
In 2018, Todd was recognized by Los Angeles Business Journal as a “Leader in Law” in the Labor and Employment category. He is a member of the Los Angeles and Orange County bar associations and the California State University, Long Beach (CSULB) HR Advisory Board. At CSULB, Todd is a lecturer in the Human Resources Management Program teaching California Labor and Employment Law. He earned his J.D. from the University of Southern California, Gould School of Law (2005) and his B.A. from the University of California, San Diego (2002).
