Fisher Phillips Lawyers Author Article on COVID Vaccine Considerations for Employers

In their co-authored article published in PEO Insider, Phillip Bauknight, Kevin Troutman, April Perkins, and Abby Harrington address various COVID-19 vaccine considerations for employers based upon the rapidly changing guidance. They start with a discussion of the guidance from the Equal Employment Opportunity Commission and the fact that it “unmistakenly signals that employers can require workers to get the COVID vaccine, even under the Emergency Use Authorization.” The authors go on to explain that “although employers can require vaccination, it does not necessarily follow that they should.” They point out that a far greater number of employers will seek to encourage their employees to get vaccinated rather than mandating it, and they discuss how employers can incentivize their workers to  get inoculated as a way to increase participation. The article goes on to list a number of other legal considerations employers should consider as they manage the vaccination process.
