Employers are expressing surprise that the Department of Labor (DOL) shares information about their investigations with private attorneys suing the companies the DOL is investigating. To clear up the confusion, Bloomberg Law interviewed Columbia partner Cheryl Behymer about how common this practice is and how these information-sharing agreements originate. Behymer told reporters: “The agencies have different structures for how they investigate discrimination. For example, the EEOC accepts bias charges directly from workers—who later can intervene in lawsuits brought by the EEOC against their employer, thus leading to the formation of a common interest agreement.”
