Irvine attorney Ashton M. Riley is quoted in the Daily Journal article titled “State high court upholds meal break waivers for health care employees,” where he discusses the California Supreme Court’s decision in Gerard v. Orange Coast Memorial Medical Center. In its decision, the Court upheld the legality of second meal break waivers for health care workers on 12-hour shifts.
Ashton believed the Court’s opinion was well reasoned and balanced, praising the Court’s decision to look at the underlying legislative intent. Ashton calls this opinion “a really nice Christmas present for employers.’
