Fisher Phillips Attorneys Discuss Federal Enforcement Agencies’ Coordinated Efforts to Address Worker Misclassification

In a SHRM article, Kathleen Caminiti and Alba Aviles discussed the Jan. 6 announcement by the U.S. Department of Labor’s and Wage and Hour Division and the National Labor Relations Board — the two agencies had agreed to collaborate to improve the enforcement of the laws administered by each other. The concentrated effort targets employers that misclassify workers as independent contractors.

“Routine wage-hour audits, employee complaints, and alleged minimum wage or overtime violations are likely to take on broader significance, and with that great exposure to damage awards and penalties,” said Kathleen and Alba.
