Advising that employers are likely to see “much more aggressive OSHA enforcement under the Biden administration,” Ed suggests that employers approach inspections with a clear understanding of boundaries. He recommends that employers set those expectations before any on-site visits. Ed also recommends that employers ask for management-level staff be present for inspections and interviews. Additionally, he advises that employers provide only the data and information that they are required to under law.
