On August 2nd, the NLRB lobbed its latest salvo in what may feel like a pattern of assaults on employee handbooks. The widely anticipated decision in Stericycle, Inc. leaves employers, once again, faced with the challenge of reexamining their workplace policies to conform with shifting priorities from the NLRB. Specifically, the decision signals a return to the Lutheran Heritage standard with rules concerning workplace civility; loitering; unlawful strikes, work stoppages, and slowdowns; and restrictions on video and/or cell phone recording all poised to receive heightened levels of scrutiny.
