In an interview with Law Week Colorado, partner Todd Fredrickson describes the uptick in coronavirus-related activism as employees continue expressing concerns about returning to work, access to protective gear, and overall safety in the workplace. He explains that, in these situations, employers need to recognize that there is a fine line between protected and unprotected conduct under the National Labor Relations Act.
In the article, Todd recommends that employers get out in front of any complaints or compliance issues and encourages them to “…walk around their facilities and note anything that could trigger health or workplace safety concerns, and then create a list of action items to resolve any problems.”
