Ray explains that affirmative action critics will likely turn their attention to challenging private employer DEI programs under workplace anti-discrimination laws. And he warns of a “potential surge” in reverse-discrimination claims brought by employees in majority populations alleging that their employers’ diversity efforts resulted in discrimination against them.
