Construction Dive Features Fisher Phillips’ Insights on COVID-19 Vaccines

Construction Dive featured the insights of Bert Brannen and Kevin Troutman in its coverage of the firm’s webinar about COVID-19 vaccines, which was hosted by the Associated General Contractors of America. During the webinar, Kevin said that he and many of his colleagues believe “…these vaccines, once they’re approved, even though it’s under the emergency use authorization, that they can be mandated.” Kevin and Bert went on to explain that there are situations in which employees can legally decline to be inoculated, and in these cases, employers should offer reasonable accommodations.
Throughout the webinar the pair explained that employers need to walk a fine line because while requiring a vaccine may result in higher participation rates, doing so can also incite pushback from employees. To help manage these situations, Bert suggested that employers listen to their employees’ concerns and document any policies put in place to require vaccination. He also suggested that contractors try to encourage participation by setting up free jobsite vaccination clinics during working hours to make it as easy as possible for their employees to take the vaccine.
