In an interview with Law.com, Adam Sloustcher weighs in on the uptick of “name, image and likeness” (NIL) work stemming from the NLRB’s memo saying student athletes should be treated as employees of schools. Adam, co-chair of Fisher Phillips’ Sports Practice, describes how the firm has been working with university clients to provide guidance, explaining that “if there’s a contract between an athlete and a third party, the university should want to take a look at it and make sure no lines are crossed, make sure it complies with state NIL rules, with the Federal Trade Commission rules and maybe other applicable rules that are out there.” The article describes that Fisher Phillips has more than 35 former collegiate athletes, including co-chair Todd Scherwin, within its Sports Practice, which makes the firm well-positioned to service what Adam expects will be an uptick in work as more and more states pass NIL-related laws.
