Charlotte Partner Discusses Possibility of OSHA Mandates for Specific Industries in Response to Supreme Court Ruling

In a Law360 article following the Supreme Court blocking the Biden administration’s vaccine-or-test mandate, Travis Vance addressed the idea that OSHA may attempt to create new mandates to ensure workplace safety.

But whatever sort of new rules, if any, OSHA decides to pursue, Travis believes that the lesson the agency will glean from the high court's ruling is that "you can't focus an OSHA standard on how many employees are in a particular workplace."

Instead, he said OSHA may home in on "hazards in the workplace."

"I think, however, they make it applicable whether it's a COVID standard or [an] infectious disease standard — they are going to have to focus on specific industries. I think that's what the Supreme Court has told the agency," he said.
