Washington state recently passed a new law that prohibits employers from using nondisclosure agreements for nearly all employment claims. Catharine Morisset spoke with Bloomberg Law about what employers need to know about this new law.
“The Washington law is beyond what we are used to seeing in response to the #MeToo movement,” she explains. “Covering wage and hour claims is novel among state NDA restrictions. The language about public policy mandates is also unusual and it appears to be aimed at the tort claim that’s available for wrongful termination under Washington law.”
