Steve Bernstein recently spoke with Bloomberg Law for insight on whether employers can legally require workers to wear face coverings in the workplace, even if their workforce is represented by a union. The article explores the legal issues at play when workers refuse to wear face coverings during the pandemic, including whether they can face discipline or termination. For unionized workplaces, Steve says the safest approach is to give the union a heads-up and communicate then [about new policies], since there’s usually a common interest in health and safety. “Having a union partner in that process can be valuable,” he added.
