Tampa Partner Steve Bernstein was quoted in an article entitled “Board Could Resuscitate ‘Quickie Election’ Rule,” on the Society For Human Resource Management website.
“Don’t be surprised if the National Labor Relations Board resuscitates the so-called quickie election rule,” said Steve.
The rule was sunk last year because the board did not have a quorum of three to pass it, he said, but that is no longer a problem. The board has five members now, and Chairman Mark Gaston Pierce has indicated the rule may come back into play, Steve explained to SHRM.org.
The board could withdraw the old rule and approve a new one with a 3-2 vote, according to Steve.
