In an interview with Law360, Josh Viau shares his insight on a recent Department of Labor (DOL) ruling that revises the H2-A visa program's regulations, including health and safety requirements for temporary worker housing as well as two wage-related reforms. Josh explains that since agricultural prevailing wage surveys can focus on the peak harvesting period rather than the entire season, the rule may result in "inflated wages." He also notes that employers must do their due diligence, such as conducting audits of payroll records. "You have to make sure that you're following up and making sure that things are being done correctly, because you've lost that potential defense of not being found a joint employer." Josh added.
