Atlanta Partner Expects ‘More Aggressive OSHA Enforcement’ Under Biden Administration

Ed Foulke, Atlanta Partner and former head of Occupational Safety & Health Administration (OSHA), talked to Portable Plants Magazine about what to expect from the administration in the coming months. Ed said that he sees the recent OSHA activity as indicative of a more robust regulatory fervor in general.
“I think you’re going to see much more aggressive OSHA enforcement under the Biden administration,” he said.
He also predicted that the imprecise nature of the Occupational Safety & Health Act’s general duty clause – which requires workplaces to remain “free from recognized hazards that are causing or are likely to cause death or serious physical harm to employees” – may leave room for inspectors to find unexpected violations.
“One thing I think you’re going to see during the Biden administration is a focus on musculoskeletal disorders – ergonomics, repetitive motions, lifting – and combustible dust,” said Ed.
