The Department of Labor has proposed a new joint employer rule that would align with the rule of the National Labor Relations Board, narrowing the definition of a joint employer and limiting a business’s employment law liability. Attorney Marty Heller spoke with reporters at SHRM and Law360 about the impetus behind the rule change. He says, “The proposed test aligns with a more modern view of the workplace. The test is a modified version of the standard that some federal courts already apply.”
