Union organizing is on the rise. According to the National Labor Relations Board (NLRB), Unions have won 80% of all representation petitions during the first half of 2023. This upward trend will likely be propelled higher by recent case law and rule changes making it even easier to organize workers. Yet many employers, especially those in historically union-free sectors, are unprepared to lawfully and effectively respond to an organizing campaign. Don’t be caught flat-footed after a union representation petition has already been filed.
