"What all of us see is it's all an uncertain area right now," said Todd B. Scherwin, a regional managing partner at Fisher Phillips, which has a practice group devoted to the gig economy. 

Fisher Phillips has been advising startups and technology companies on potential legal hurdles they might face. The question surrounding employee classification is an issue that often comes up, said Scherwin. 

Ideally, every business would like to sustain itself by only hiring independent contractors, but if employees "are doing something your business does, it is going to be hard to prove they are an independent contractor," Scherwin said.
