A Discussion on MSHA’s Proposed Mobile Equipment and Powered Haulage Rule

After years of anticipation, MSHA has proposed a rule on mobile and powered haulage equipment (excluding belt conveyors) at surface mines and surface areas of underground mines. MSHA is proposing that mine operators be required to develop and maintain detailed written safety plans for mobile and powered haulage equipment and appoint a “responsible person” for purposes of that plan. This proposed rule affects both the coal and metal/non-metal sectors alike. Comments in response to the proposed rule are due to MSHA by November 8, 2021 and members of the mining community are encouraged to submit comments.
