Scot is representing Chief William Kalbaugh in a case involving a disability claim by an Ohio firefighter who lost vision in one eye.
The appeals court overturned an Ohio federal court's grant of summary judgment to the City of Stow, Ohio, on the firefighter's discrimination claims under the Americans With Disabilities Act and state law, but affirmed the dismissal of his ADA and First Amendment retaliation claims.
According to the article, the court remanded the claims it revived to be heard by a different district court judge after the firefighter argued that the district court's handling of discovery in the case suggested that U.S. District Judge John R. Adams was biased against him.
