This presentation will (1) examine the many recordkeeping pitfalls that employers face, especially those with multiple locations and those using temporary employees; (2) cover how to coordinate your injury and illness recordkeeping with other recordkeeping requirements and how employers can effectively use recordkeeping to improve their current safety and health management program; and (3) examine in detail the changes made by the final rule and, in particular, the increased employer reporting requirements for all employers and (4) properly posting and electronically filing your recordkeeping data.

Topic: Effectively Handling an OSHA Inspection: The Legal Aspects of OSHA and Citation Defense

OSHA continues to be more aggressive about inspections and regulation enforcement.  The number of Federal OSHA inspections resulting in penalties in excess of $100,000 has been dramatically increasing over the past several years. This number will continue to grow significantly when OSHA penalties increase 82% in August, 2016.  This interactive and comprehensive presentation will offer attendees an in-depth, practical examination of the Occupational Safety and Health Act (the “Act”) and how it and the Secretary of Labor’s right to enforce the Act may potentially affect the inspected facility and the company’s business objectives. This webinar will take attendees through the inspection process, including pre-inspection, opening conference, walk-around inspection, document production, employee interviews, closing conference, informal conference, appeals and hearings before the OSH Review Commission. Attendees will be provided a step-by-step discussion of the legal and practical process implicated when OSHA arrives for an inspection, how to define the scope of the inspection, and how to effectively assert your legal rights when OSHA is being unreasonable. This webinar will provide attendees essential tips for what every manager should do while the inspection is being conducted and afterward to help achieve the best possible outcome. Finally, the webinar will examine how to assert your legal rights and know their limitation during an inspection and the relationship of OSHA inspections to other regulatory and business responsibilities as well as the ramifications that may result from the payment of citations.

Topic: Active Shooter Training – What You Need To Know To Protect Your Employees

In addition to the traditional health and safety hazards on the job, millions of workers also experience the threat of violence in the workplace every year ranging from physical assault to homicide.  Since 2009, deaths from active shooter incidents are up 150%.  A key area of concern are "active shooter" events, an incident where an individual(s) is actively engaged in killing or attempting to kill people in a confined and populated area, typically through the use of firearms. Although workplace homicides decreased from 518 in 2010 and 542 in 2009, such events are still a cause for concern and need to be proactively addressed.

This program will provide participants with a proven strategy for developing and implementing an effective and comprehensive “Workplace Violence” program with a focus on active shooter events. Mr. Foulke will demonstrate that making the right preparations ahead of time will eliminate active shooter incidents and/or significantly reduce their impact.

Topic: OSHA Walking-Working Surfaces & Fall Protection

This program examines the current OSHA walking and working surface requirements and the status of current rulemaking to revise this standard.  In addition, the session discusses other recent changes implemented in standards, regulations and programs under the oversight of OSHA.  These include changes to the recordkeeping and hazard communication standards.  The program also reviews current standard rulemaking and what new standards most likely will become final rules before the end of the Obama administration.  Finally, the session looks at new OSHA emphasis programs, interpretation of standards and OSHA’s added emphasis on enforcement and whistleblower complaints.

Topic: Developing Safety Managers Into Corporate Leaders

This presentation will focus on the skills necessary for Safety Managers to become leaders in their companies.  The program will examine how to effectively communicate to the C Suite to not only get C Suite recognition of Safety’s contribution to the company’s bottom line but also to engage front-line employees in dramatically improving the company’s safety program.  The program will examine methodology for demonstrating to senior executives the creditable ROI of safety programs that will drive business improvement.  In addition, the presentation will examine how Safety Managers can more effectively influence upper management and hourly employees to become effective leaders.  Finally, this session will discuss characteristics of world-class companies and explore how the knowledge of those characteristics can be used to bring Safety to a seat in the C Suite.
