In an article published by Law.com, Lonnie Giamela discussed the Ninth Circuit's ruling that California's Senate Bill 399, which bars employers from disciplining workers who decline to attend meetings about religious or political matters unrelated to their job duties, likely violates employers' First Amendment rights. He, along with Fisher Phillips partner Todd Lyon, represented the California Chamber of Commerce in the appeal.
Lonnie called the ruling "especially significant given other states have adopted similar laws," noting that there have been legal challenges against similar laws in Minnesota and Connecticut. "The Ninth Circuit's decision does not bind courts in those states, but its reasoning gives them an important appellate perspective to consider," said Lonnie.
