Labor Relations Co-Chair Discusses NLRB’s Proposed Test for Workplace Monitoring

In an interview with Law360, Steven Bernstein shares his insights on Jennifer Abruzzo’s latest initiative, which is aimed at addressing the rise of workplace monitoring technologies. He explains that the test could apply to more employers than any other initiative Abruzzo has undertaken because of the scope of technologies it seeks to cover. "This appears to be an effort to extend the Obama-era standard not to a written policy but to a host of practices that fall within this broad and somewhat vague umbrella of technology and innovation," Bernstein said. "Those are concepts that don't necessarily lend themselves to the printed page, and they're ever-evolving by their nature."
