In an article published by Business Insurance, Alden Parker shared his perspective on California’s new law requiring restaurant chains with 20 or more locations to disclose major food allergens on menus in their California locations. Alden cautioned that the law “puts the onus on the business to declare what allergens are in the dish,” and warned that personal injury lawyers are likely to aggressively pursue cases, especially in the months when some restaurants may still have compliance gaps. He also highlighted the fact that digital menu disclosure must be accessible to visually impaired guests, noting that last year the top five plaintiffs in class action filings nationwide were visually impaired individuals claiming defendants’ websites were not ADA-compliant.
