In a webinar for the National Council of Agricultural Employers covered by The Packer and Pork Business, Chris Schulte explained the latest legal developments in a court case challenging the Department of Labor’s interim final rule that established a new methodology for setting the Adverse Effect Wage Rate. Chris noted that “the work that’s been done since last fall under the new wage rule, that’s all fully paid,” and that at worst, any back pay would cover the period from the date of notice until a new wage rate is established. He added that the threat of back pay “adds uncertainty on top of uncertainty.”
