In an article published by Reuters, Usama Kahf discussed the impact of California Gov. Gavin Newsom signing SB 690, which strips the private right of action from the pen register provision of the California Invasion of Privacy Act (CIPA). Attorneys at Fisher Phillips have estimated that over 4,700 lawsuits have been filed in California or invoked California law relating to digital wiretapping since 2022, about two-thirds of them including a claim under CIPA’s pen register provision.
“It’s plugging one hole,” Usama said of SB 690. “When you plug one hole, the water is going to find another hole.”
