Despite substantial opposition from agricultural industry groups, Governor Newsom signed AB 2646, establishing a new minimum wage for certain agricultural employees beginning January 1, 2027. The law is expected to affect employers that use the H-2A program. For growers and farm labor contractors, its reach may extend beyond H-2A workers to other employees who qualify as “corresponding employees” under California’s new definition—a standard that differs from the federal H-2A concept of corresponding employment.
