Executive Order 14398, issued on March 26, 2026, addresses federal contractor obligations regarding racially discriminatory activities, including Diversity, Equity, and Inclusion ("DEI") practices. Guidance on compliance and enforcement of this Executive Order has been released, creating new and immediate obligations for federal contractors. This guidance imposes strict reporting, monitoring, and flow-down requirements and sets forth new enforcement schemes for the contracting community.
With key deadlines beginning April 24, 2026, organizations must act quickly to understand and comply with the new requirements or risk contract termination, debarment, and False Claims Act exposure.
