Commissioner” discussed the California Labor Commissioner's recent ruling, in which they ruled a San Francisco driver suing Uber Technologies Inc. for expenses was an employee and not an independent contractor.

John told Law360 on Wednesday that the issue of misclassification as an independent contractor is heating up in California due in part to increased regulation and litigation by worker advocates.

 "If the driver is performing a service 'integral' to a business, this often is a red flag for the court to look closer at the other elements of the independent contractor test," John said.
