Judges encourage settlement and they encourage compromise, according to Mike. Even if such compromise is not possible, they want to know an earnest effort was made.
In order to get the settlement ball rolling, parties need to start somewhere, Mike wrote. They need to stake out positions, and this cannot happen without communication.
