Colorado Court of Appeals Decision Helps Clarify Vacation Pay Policies, Denver Attorney Says


A Colorado Court of Appeals decision in Clark’s Market v. Nieto gives HR and legal departments more assurance that they can place conditions on unused vacation pay under the Colorado Wage Claims Act. Quoted in a Law Week Colorado story, Denver attorney Susan Schaecher says the decision clarifies the court’s interpretation of the CWCA and is helpful to employers who might have been uncertain about whether they could implement certain vacation pay policies.
