Attorney Responds to’s Question of the Week


Michael Avila of Philadelphia authored the response to’s “Question of the Week - I’m expanding my U.S. company, and planning to open up offices in the U.K. and EU. How should I approach the wage and hour laws in those jurisdictions, and do I have to pay my new UK and EU employees more overtime?”

Michael recommends learning all the laws and regulations of each country in which your company has employees, as they vary across EU Member states and the UK. For example, the maximum working hours may differ between neighboring countries in the EU, or one country may allow overtime exemptions for certain positions and one does not. There are potentially severe consequences for mishandling overtime entitlements, calculations, and payments, so Michael recommends finding employment counsel to guide you.
