The U.S. Department of Labor (“DOL”) recently indicated that it is aggressively going after employers for improperly designating employees as independent contractors. Since this issue is priority for the DOL, we want to help bring you up to date on what’s important to the DOL and discuss the key factors used in determining whether an employee is actually an independent contractor.
