Not only is recreational cannabis legal for adult use in New Jersey, but employees are also protected from adverse employment actions based solely on their lawful use of recreational cannabis. This protection has raised questions and concerns for employers worried about their employees’ use of cannabis and the effect it may have on their safety and productivity in the workplace, as well as the impact on their drug-free workplace and drug testing policies.
