Fisher Phillips Partner Speaks to New York Times on NLRB Classification of Student-Athletes

In an interview with The New York Times, Joseph Amabash discusses a new memo from the NLRB’s general counsel that warns universities against “misclassifying such employees as mere ‘student-athletes.’” “For employers, this is telling is that there’s going to be a lot more litigation and a lot more vigorous enforcement of the N.L.R.A. against employers,” Joseph says. Additionally, Joseph says this represents a stark departure from the previous administration: “There’s a complete swing: under the Trump board there were many, many, many decisions that were favorable to employers. Under the Biden board they may reverse some decisions and make them more friendly to labor.”
