Overview

Nicole Holtzapple is an associate in the firm’s Atlanta office. Her practice is focused on representing employers and individuals before state and federal courts in a wide range of matters with a particular focus on employee defection and trade secrets. Nicole’s experience includes litigating business and intellectual property cases in both federal and state court, including breach of contract, fraud, Georgia Fair Business Practices Act, copyright infringement, and data privacy matters. She regularly utilizes her experience to counsel clients in matters involving restrictive covenant and trade secret litigation, retaliation, discrimination, and harassment. Nicole also reviews and drafts severance agreements, confidentiality agreements, and non-compete and non-solicitation agreements for clients to ensure compliance with changing laws and regulations.

Prior to joining Fisher Phillips, Nicole was a senior associate for a full-service AmLaw 100 firm in Atlanta where she conducted depositions, responded to written discovery, drafted and defended against motions to compel and negotiated discovery disputes, and more. During her time there, she was part of a team that obtained a rare grant of summary judgment in the U.S. District Court for the Southern District of Georgia in a software breach of contract matter.
