Overview

Kimberly Ward has extensive experience defending employers in federal and state courts against workplace law disputes, including Title VII, ADA, ADEA, FMLA, wage and hour, and state law claims.  In addition to her litigation practice, Kimberly investigates and assists entities to effectively respond to complaints pending before the Equal Employment Opportunity Commission (EEOC), the Department of Labor, the Department of Education, the Office of Civil Rights, and the U.S. Department of Housing and Urban Development.  She is also skilled at providing clients with strategic advice to avoid litigation regarding issues such as employee leave, employee discipline and termination, and requests for accommodation. 

Kimberly also has experience drafting employment agreements and enforcing restrictive covenants on behalf of employers.  She also regularly drafts and reviews employee handbooks for compliance with state and federal laws, and partners with employers to provide EEO training to managers and staff in an effort to proactively avoid litigation.  Kimberly has clerked before both the U.S. Court of Appeals for the Eleventh Circuit (Judge Joel Dubina), and the Supreme Court of Alabama (Justice Champ Lyons Jr.) and handled appeals on behalf of clients before the Alabama Supreme Court, the Eleventh Circuit Court of Appeals, the Ninth Circuit Court of Appeals, and the Tenth Circuit Court of Appeals.    

Kimberly has previously served as the Vice President of Legal and Legislative Affairs for Birmingham SHRM (BSHRM) from 2015-2017, Vice President of the Alabama Lawyers’ Association from 2006-2007, Treasurer of the Capital City Bar Association from 2004-2005, and served on the Alabama State Bar Association Young Lawyers’ Executive Committee from 2005-2007. 

Prior to joining Fisher Phillips, Kimberly was Special Counsel for a global labor and employment law firm where she litigated employment law claims across the United States, including discrimination and harassment and leaves of absence and accommodation matters.
